These Terms of Service ("Terms") govern your access to and use of the Instavid.pro platform ("Service", "we," "us," "our"). By using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Overview of the Service

Instavid.pro is a software-as-a-service (SaaS) platform that allows users to create videos automatically using artificial intelligence. The Service enables you to:

Choose a topic and format for your video from a variety of options.
Customize your video with multiple visual styles, soundtracks, and narration voices.
Automatically generate videos optimized for various platforms like TikTok, Instagram, YouTube, and more.

2. Eligibility

To use Instavid.pro, you must:

Be at least 18 years old or the legal age of majority in your jurisdiction.
Provide accurate and complete information when creating an account.
Agree to these Terms and comply with all applicable laws and regulations.

3. Account Registration and Security

You must create an account to access the full functionality of the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
Notify us immediately of any unauthorized use of your account or other security breaches.

4. Acceptable Use

By using Instavid.pro, you agree to:

Use the Service only for lawful purposes and in accordance with these Terms.
Not use the Service to create, share, upload, or distribute content that is pornographic, sexual, violent, hateful, harassing, defamatory, misleading, illegal, or otherwise violates the rights of others.
Not use the Service to generate content that promotes or facilitates illegal activities, self-harm, or the spread of misinformation.
Not use the Service for spam, unsolicited communication, or other disruptive activities.
Not attempt to exploit, reverse-engineer, decompile, interfere, or manipulate the Service in ways that alter its intended functionality, compromise security, or violate applicable laws and regulations.

The Service reserves the right to remove, restrict, or report any content that violates these terms or the policies of the platforms on which the content is shared.

By using the Service, you acknowledge and agree to abide by these terms and accept that violations may result in suspension or termination of access without prior notice.

5. Content Ownership and Rights

Your Content: You retain ownership of any content, topics, or ideas you provide to Instavid.pro for video creation. By using the Service, you grant us a license to use, store, and process your content solely for the purpose of providing the Service.
Generated Content: Videos generated by Instavid.pro are yours to use, subject to these Terms.
Intellectual Property: All intellectual property related to the Instavid.pro platform, including but not limited to the software, algorithms, and designs, remains our property.

6. Fees and Payments

Free Video Creation: Instavid.pro allows users to create one video for free using basic-quality generative AI models.
Paid Plans: The ability to create more videos and access to higher-quality generative AI models and additional features requires a paid subscription. Pricing details are available on our website.
Payment Terms: You agree to pay all applicable fees and authorize us to charge your payment method on a recurring basis for subscription plans.

7. Refund, Cancellation, and Plan Change Policy

We want you to have a great experience with Instavid.pro. If you are not satisfied with our service, our refund and cancellation policy is as follows:

Refund Policy

If you decide that Instavid.pro is not right for you within the first 30 calendar days of signing up and have not created any videos, you may request a full refund for your first month’s payment.
If you have created videos within the first 30 days but still wish to request a refund, we will issue a prorated refund for the unused days of your subscription.

Cancellation Policy

After the first billing period (one month), you may cancel your subscription at any time. However, no refund will be issued.
Upon cancellation, your subscription will remain active until the end of your current billing cycle, after which it will automatically terminate, and no further charges will be applied.
To cancel your subscription, you may do so at any time by going to the section called "My Account" on the Instavid.pro platform (you'll need to be logged in), then by clicking on the "Manage Plan & Billing" button, and then clicking on the "Cancel Subscription" button.

Changing your Subscription Plan

You may upgrade or downgrade your subscription plan at any time by going to the section called "My Account" on the Instavid.pro platform (you'll need to be logged in), then by clicking on the "Manage Plan & Billing" button, and then clicking on the "Update Subscription" button.
If you upgrade your plan, you will be charged the prorated amount for the remaining days of your current billing period and your account will be upgraded immediately to the new plan.
If you downgrade your plan, the change will take effect until your current billing period (a month) has ended. This means your current plan will remain active until the end of your current billing period and the new plan you are downgrading to will take effect until the next billing period has started.

8. Termination

We may suspend or terminate your account if you violate these Terms or engage in any prohibited activities.
You may cancel your subscription at any time. Upon cancellation, your access to the Service will continue until the end of your billing cycle.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied.
We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific needs.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
Our total liability to you for all claims related to the Service will not exceed the amount paid by you to us in the preceding 12 months.
As a user you are solely responsible for any content you create using the Service.

11. Modifications to the Terms

We may update these Terms from time to time. If we make significant changes, we will notify you by email or through the Service.
Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.

12. Governing Law

These Terms are governed by the laws of Nuevo León, México, without regard to its conflict of laws principles.
